Welcome to CloudMailVault.com (“CloudMailVault,” “Company,” “we,” “us,” or “our”). By registering for an account, accessing our website, or using any of our email hosting, archiving, vaulting, or cloud services (collectively, the “Services”), you (“Customer,” “User,” or “you”) agree to be bound by these Terms of Service (“Terms”).
If you do not agree to all of these Terms, you may not access or use our Services.
1. Account Setup, Identity Verification, & Eligibility
1.1 Accuracy of Information
You agree to provide true, accurate, current, and complete information when creating an account and placing orders. You are responsible for keeping your contact and billing details updated at all times.
1.2 Verification & Fraud Prevention
To prevent unauthorized access, identity theft, and infrastructure abuse, CloudMailVault reserves the right to request identity verification documents or proof of address prior to or after account activation. We reserve the right to decline service or cancel pending orders at our discretion if verification requirements are not met.
1.3 Account Security
You are solely responsible for maintaining the confidentiality of your account credentials, API keys, and root/admin passwords. You assume full responsibility for all activities, data transmissions, and charges incurred under your account.
2. Acceptable Use & Compliance
Your use of our Services is strictly governed by our Acceptable Use Policy (AUP).
You agree not to use the Services for any unlawful, fraudulent, or harmful activity, including but not limited to transmitting spam, unsolicited bulk commercial email, hosting malicious scripts, phishing, or infringing upon third-party intellectual property rights.
CloudMailVault reserves the right to immediately suspend or terminate any account or service found to be in violation of the AUP without prior notice or refund liability.
3. Payments, Billing, & Refunds
3.1 Subscriptions & Automatic Renewals
All recurring plans (monthly, annual, or multi-year) are billed in advance on a recurring cycle. Unless you cancel your subscription before the next billing date via your client portal, your plan will automatically renew, and your saved payment method will be charged.
3.2 Lifetime Plans & One-Time Deals
Lifetime Deals grant access to the specified tier of Services for as long as CloudMailVault operates that specific platform or infrastructure tier.
Lifetime Plans are non-transferable and strictly non-refundable once activated.
Upgrading or expanding Lifetime Plan storage is subject to availability and current upgrade pricing at the time of request.
3.3 Chargebacks & Payment Disputes
Initiating an unauthorized credit card chargeback or PayPal dispute will result in immediate suspension of all associated accounts and services. To restore access, the disputed amount plus any chargeback or administrative fees incurred by CloudMailVault must be paid in full.
3.4 Refunds
Except as explicitly required by law or specified in a promotional guarantee, payments made to CloudMailVault are non-refundable.
4. Service Availability, Backups, & Data Responsibility
4.1 Service Availability (Uptime)
While CloudMailVault strives to maintain high availability and reliability across our enterprise data center facilities, we do not guarantee uninterrupted or error-free operation unless explicitly covered by a separate enterprise Service Level Agreement (SLA).
4.2 Data Retention & Backups
Customer Responsibility: Except where automated archiving or vault backup services are explicitly included in your subscribed plan, you are solely responsible for maintaining independent, off-site backups of your email data, domain configurations, and content.
Data Loss: CloudMailVault is not liable for data loss, file corruption, or service disruptions caused by hardware failures, third-party cyberattacks, user misconfiguration, or account cancellation due to non-payment.
5. Account Suspension & Termination
5.1 Cancellation by User
You may request service cancellation at any time via the CloudMailVault client portal. Cancellation takes effect at the end of your current billing cycle unless immediate cancellation is requested.
5.2 Termination by CloudMailVault
We reserve the right to suspend or terminate your account or access to Services immediately, without prior notice or liability, for:
Non-payment or past-due invoices.
Material breach of these Terms or the Acceptable Use Policy.
Conduct that poses a security risk to CloudMailVault, our network, or other customers.
Compliance with court orders, subpoenas, or legal mandates.
5.3 Data Purging Upon Termination
Upon account termination or cancellation, all associated data, archived emails, and configurations stored on CloudMailVault servers may be permanently deleted from our primary systems. Deleted data cannot be recovered.

1. Abuse Definitions

1.2 Unsolicited Communications & Email Misuse
Prohibited Outreach: Unsolicited communications consist of any email transmission sent without the explicit, verifiable consent of the recipient or a reasonable expectation of receipt.
Included Categories: Prohibited outreach includes, but is not limited to:
Spam, cold outreach, and unsolicited bulk commercial messaging.
Mass marketing campaigns and purchased lead generation lists.
Phishing, domain spoofing, deceptive messaging, and malware transmission.
List Sourcing: The use of rented, scraped, harvested, purchased, or otherwise non-consensually collected recipient lists is strictly prohibited.
Evasion & Controls: Any attempt to circumvent, bypass, or manipulate CloudMailVault abuse filters, outbound sending quotas, rate controls, or reputation management relays is forbidden.
Penalties: Initiating or permitting unsolicited communications is grounds for immediate service termination and a permanent ban across all CloudMailVault services.
1.3 Malicious Content & Illegal Activity
Executable & Harmful Code: Hosting, relaying, or storing scripts, executables, or payload files intended to execute harmful actions against third parties or triggered via bulk automations is prohibited.
Legal Compliance: Content hosted, vaulted, or sent through CloudMailVault must comply with all local and international laws governing the jurisdiction where the server or customer resides.
Consequences: Hosting or distributing malicious content will result in immediate service termination without prior notice.
2. Enforcement & Remedial Action
2.1 Malicious & Intentional Infringements
Intentional abuse includes any action knowingly performed by the account holder or authorized third-party users that violates the abuse definitions in Section 1.
2.2 Violation Response & Resolution Process
When a potential violation or abuse event is detected:
Service Suspension: CloudMailVault reserves the right to immediately isolate or restrict affected accounts to mitigate infrastructure damage or external delivery impact.
Support Ticket Notice: A priority abuse notification ticket will be generated and sent to the primary contact email registered on the account.
Reactivation Protocol: Once the account holder responds acknowledging the breach and provides a viable remediation plan, services may be reactivated. The account holder then has 24 hours to fully rectify the underlying issue and prevent recurring offenses.

When actionable evidence of DNS or domain abuse is verified, CloudMailVault will take prompt steps reasonably necessary to disrupt the malicious activity, including domain holds, DNS record resets, or suspension.
3.3 Prohibited Account & Domain Practices
Registering or maintaining accounts with fraudulent or intentionally inaccurate contact information.
Utilizing CloudMailVault resources to infringe upon third-party copyrights, trademarks, or intellectual property rights.

To report violations of this Acceptable Use Policy, please submit details to our compliance desk at abuse@cloudmailvault.com. We retain all abuse logs and audit records for a minimum of two (2) years. Failure by account owners to respond to or resolve valid abuse reports will lead to service suspension or total termination.
